THE CHALLENGES OF REINSERTING A GRADUATE TO SOCIETY AND THE APPLICABILITY OF THE CRIMINAL EXECUTION LAW IN FLORIANO-PI AND BRAZIL

Abstract

The Penal Enforcement Law (LEP) presupposes ample assistance and guarantees for inmates. However, the discrepancy between theory and practice in the application of national legislation reveals a failure on the part of the state to comply with its legal duty, thus hindering the reintegration of inmates into society. In view of this, the aim of this article is to analyze the challenges of reintegrating convicts and the applicability of the LEP, especially in the municipality of Floriano-PI. The qualitative documentary-exploratory research analyzed the legislation, traced its history and investigated the local prison reality. The study also consisted of a bibliographical analysis of books, articles and literary journals, using the deductive method to assess the general situation of the issue in question. In this vein, the study's objectives include exploring the difficulties faced by convicts, from the execution of their sentence to their reintegration, and examining society's stance. The work is divided into four parts, dealing with the LEP, the theory of punishment, social labeling, analysis of three research reports carried out with inmates in the Gonçalo de Castro Lima prison system and considerations on resocialization and reintegration into the job market, including public policies to achieve the state's goals of resocialization. It is believed that this work may inspire more in-depth studies on the subject, in order to align the principles of justice and human dignity.
