THE IMPACTS OF THE INTERNATIONAL TREATY ON PHYTOGENETIC RESOURCES FOR FOOD ON THE LEGAL PROTECTION OF AGROBIODIVERSITY

The issue of preserving species, whether flora or fauna, is taking up more space on the agendas of nations globally every day, given the imminent concern of food shortages for the world population, resulting from the economic and development model practiced by humanity. However, little is known about the specific protection of agricultural species in the face of such a serious threat. Therefore, this research dealt with the legal impacts on traditional Brazilian agricultural systems based on the International Treaty on Plant Genetic Resources for Food. His investigative path was guided by the following problem: what are the impacts of Brazilian legal standards in relation to agrobiodiversity for traditional agricultural systems existing in Brazil? To this end, the general objective was to analyze the Brazilian legal rules protecting agricultural biodiversity and its consequences for traditional agricultural production systems. Accompanied by its specific objectives, it set out to contextualize the International Treaty on Plant Genetic Resources for Food in the Brazilian legal system; talk about the main agricultural production systems in Brazil and identify the impacts of Brazilian legislation to protect agrobiodiversity on these systems. In this direction, bibliographical and documentary research, of a qualitative nature, was adopted as an investigation methodology, through the search for documents, books and studies already published in articles on the subject in the last ten years in the national territory. The research demonstrated that Brazilian legislation to protect agrobiodiversity, even though it is intended to offer security and guarantees to Brazilian agricultural systems, in fact especially benefits the agribusiness model of large-scale production for export, to the detriment of the still remaining creole cultures, which impoverishes the Brazilian genetic pool and creates difficulties for traditional food production systems.
