THE ROLE OF THE STATE IN PROTECTING FREEDOM AND THE REGULATION OF HATE SPEECH ON THE INTERNET

This study has the general objective of showing the main challenges faced by the State in regulating hate speech on the internet. The motivation to address this topic comes from the desire to contribute to the promotion of a healthier and safer online environment, in which people can express themselves freely, but without spreading hate and violence. The methodology used in this article was descriptive research, with a qualitative approach. A bibliographical survey was carried out in a specific period, using publications indexed in the SciELO and Google Scholar databases, between the years 2017 and 2023. Upon concluding this study, we came to the understanding that in the digital era, where communication and dissemination of information is instantaneous and global, it is important to recognize that freedom of expression is not absolute and that it can have significant consequences for those who propagate hate speech. Therefore, it is necessary to repudiate any form of hate speech and promote digital education, teaching users the impact their words can have and encouraging respect for diversity and human dignity.
