CRIMINAL REVIEW AND HUMAN RIGHTS: AN ANALYSIS OF CRIMINAL REVIEW FROM THE PERSPECTIVE OF HUMAN RIGHTS

The general objective of this work is to analyze criminal review in the light of human rights, seeking to understand how this procedural institute can contribute to the effective protection of people's fundamental rights. As a methodology, descriptive research was carried out, with a qualitative approach, where the bibliographical survey was carried out over a period of time, between the periods of 2017 and 2023. This work brought a very significant basis for analyzing the theoretical and legal foundations of a process criminal offense with the aim of analyzing a conviction or a final decision. Upon concluding this study, we came to the understanding that criminal review is an important legal procedure that aims to re-examine a judicial decision that has already become final, that is, not subject to appeal. It can be requested when there is a possibility of proving the defendant's innocence or discovering new evidence that could change the outcome of the trial.
