Abstract

This article has the general objective of identifying whether individuals who have Antisocial Personality Disorder (ASPD) or Psychopaths are treated under Brazilian criminal law as attributable, semi-attributable or non-attributable. As specific objectives, to address the concept and theories of culpability; Discuss the effectiveness of the application of criminal punishments on the agent; Point out the behavioral characteristics of psychopaths and analyze a real practical case. It was used as methodology, a bibliographic research through technical-bibliographic procedure. To obtain the theoretical material, the Scielo and Capes platforms were used. The research was justified by the need for completed studies that clarified the application of art.26 of the penal code and investigated the unknowns surrounding the theme.
