SHARED CUSTODY AND ITS IMPLICATIONS ON THE LIVES OF CHILDREN WITH DISABILITIES

This article proposes the analysis of shared custody and its repercussions on the daily lives of children with disabilities. The aim is to address the historical panorama of the family institution, exploring the concept of family power and custody, in addition to differentiating the existing types of custody. Special attention will be devoted to the recent implementation of shared custody in the Brazilian legal system, highlighting its specific implications in the lives of children who face challenges related to disability. From a methodological point of view, the Inductive Method is adopted with a qualitative approach. The procedure used is descriptive-explanatory in nature, supported by a Bibliographic Review research. The central question of this study aims to understand: what are the implications of shared custody in the lives of children with disabilities? The research hypothesis is that children with disabilities often benefit from stable routines and environments. Shared custody can disrupt routine and stability as the child will alternate between two different homes and sets of rules. It is concluded that it is essential that parents, together with health professionals, social workers and, if necessary, the judicial system, work together to ensure that shared custody is adapted to the specific needs of the child with a disability and that their well-being be the top priority.
