Abstract

This article's study was based on morals and ethics, aiming to study and improve knowledge regarding the labor rights of people living with the HIV virus, with the central objective of demonstrating the importance of protecting and guaranteeing the rights of people living with HIV in the work environment. Therefore, with the perspective of developing the study on the topic, we sought to produce knowledge, as this is the field of investigative interest. The following descriptors were used to search for articles: hiv/aids and human rights, labor rights and principles of people living with the hiv virus and priority in the procedural process amid reflection on the law that shows the importance of guidance for prevention against prejudice and discrimination between employees and companies. To carry it out, research using a deductive method and technical bibliographic procedure is used. Given this, in contemporary society, one of the greatest difficulties that people face is having to live with HIV/AIDS, due to different situations. This research aims to demonstrate, through a bibliographical review, the social conflicts that people who have HIV face, often hindering their rights, leaving them increasingly vulnerable, as well as the constitutional principle of the dignity of human person, with the person causing the damage having the obligation to repair the damage caused.
