This article's have objective is to conceptualize the notable advancement of the new Family modality, in addition to analyzing the possibility of shared custody of pets after the dissolution of unions in Brazil in the context of the emerging family modality in advancement. Furthermore, this article highlights the importance of legal recognition of this new form of family, aiming to mitigate legal insecurities in the Brazilian legal system. In summary, this study investigates the possibility of shared custody of pets in scenarios of union dissolution in Brazil, inserting it into the new family dynamics. It also highlights the relevance of its recognition by the Brazilian Civil Code to avoid legal gaps and legal insecurities in the Brazilian legal system, as well as the importance of approving Bill 179/2023 to consolidate the recognition of this new type of family in the country's legal context.
