Abstract

The work that will be developed from the present project intends to analyze the conflict between the decisions taken by the Federal Supreme Court and international bodies, more specifically in the Inter-American System of Human Rights, considering the normative status of the treaties in Brazil. The conflict between the jurisprudence of the Federal Supreme Court and the Inter-American Court of Human Rights Law 6.683/79 (Amnesty Law) is the place from which the research starts, analyzing the legal aspects taken up by the STF and the Court of Human Rights in their respective decisions, focusing on the perspectives brought by the Federal Constitution of 1988 and the American Convention on Human Rights. Thus, an effort is made in an attempt to outline possible solutions to the conflicts.
