THE PRACTICE OF THE CRIME OF INJURY FROM THE PERSPECTIVE OF THE VIRTUAL ENVIRONMENT

The present study aims to analyze the practice of the crime of injury from the perspective of the virtual environment. And specifically, describe the crime of insult in accordance with the Penal Code and the ways in which insult is manifested in the virtual environment; highlight the legal and jurisprudential implications arising from cases of virtual injury; and discuss the social and psychological impacts of injury in the virtual environment on victims. This is a bibliographical research, whose approach is descriptive and explanatory, using a deductive method. Cyber-lime cases often present legal challenges such as the difficulty of tracking down perpetrators and the need to adapt legislation to deal with the constantly evolving online environment. The jurisprudence analyzed demonstrated the importance of a flexible and updated interpretation of the law to guarantee justice in investigations and trials related to virtual injury. However, it is worth highlighting that insult in the virtual environment has significant social and psychological impacts on victims, with the stigma associated with public exposure and the consequences for the victims' mental health as the main results of insult crimes in the virtual environment. To mitigate these impacts, it is essential to promote prevention, education and awareness strategies in the online context, encouraging mutual respect and digital responsibility. Therefore, this study contributes to a more comprehensive understanding of injury in the virtual environment, highlighting the importance of addressing the legal, social and psychological aspects involved.
