MANUFACTURERS’ RESPONSIBILITIES IN THE CONSUMER DEFENSE CODE

Companies are institutions of great relevance in the legal system, as they constitute a determining factor for economic, social, technological development, among others; which means that they are subject to the fulfillment of multiple duties, which, ultimately, aim to guide the way in which the aforementioned entity should behave in different circumstances and even in relation to its procedures. However, despite having a fundamental role, on many occasions, companies, instead of having a positive effect, exert a negative influence, to the point of causing damage or negative effects to their recipients, consumers, which is reflected in their life, health and environment; and, to that extent, give rise to liability. Therefore, this article aims to analyze the main responsibilities of manufacturers when supplying their products to the market. To achieve the objective, a bibliographical research was carried out in articles and books that deal with the topic, with a conceptualization of the generic aspects of the producer's criminal liability and, finally, considerations were developed that allow to substantiate this "special or specific" guarantee position. " from the highest business body in that situation — properly introducing a product to the market.
