The he condition of prisons in Brazil represents one of the most pressing challenges linked to public security and prison administration in the country. The existence of conflicts between criminal groups, the lack of adequate health infrastructure, the excess of inmates, the lack of state presence, among other factors, highlight the lack of opportunities for the reintegration of inmates. Due to these issues, it is appropriate to promote a discussion on how custodial sentences are served in Brazil and the present study aims to identify the main problems highlighted by the doctrine in the Brazilian prison system. To this end, a bibliographical review is used, based on scientific studies selected from studies by Cunha (2020), Dick (2021), Torres and Nunes (2020), Lacerda (2023) and Santos (2019), among others, whose time frame was between 2018 and 2023 found in databases such as Scielo and Google Scholar. The results show that overcrowding is one of the most serious problems in the Brazilian penitentiary system. This is where other prison problems arise, such as recidivism and the increase in crime inside and outside prisons. In this way, it is clear that custodial sentences do not fulfill their purpose, requiring urgent measures to solve the problems presented.
