THE POWER OF THE VETO IN THE UNITED NATIONS (UN) SECURITY COUNCIL: AN ANALYSIS IN THE LIGHT OF THE PRINCIPLE OF SOVEREIGN EQUALITY

Abstract

This article has as its theme: The power of the veto in the Security Council of the United Nations (UN). The overall objective is to ascertain whether the veto power of the permanent members of the Security Council violates the very nature of the UN in light of the principle of Sovereign Equality described in Article 2, principle 1, in the Charter of the United Nations. The methodology employed was through legal research, of an exploratory nature, being bibliographic and documentary, with qualitative analyses, considering that doctrinal understandings were observed, presenting the legal basis adhering to this law internationally, which supports the P5 and the Principle of Sovereign Equality, in its Charter of the United Nations, seeking in this context to analyze the effects of the power of veto, in order to verify whether it violates the UN Charter, in the light of the principle of Sovereign Equality, as a result of the powers exercised by the permanent members. To ascertain whether there are jurisprudential decisions of the Security Council, and of the Court (ICJ) to establish the theses addressed. It is concluded that there is a divergence in the application of the use of the Veto Power granted only to permanent members.
