Affective relationships are subject to legislative regulation, as soon as the state understands that these relationships are understood to be a family entity, and therefore receive state protection. This study will analyze the dating contract as a method of disqualifying the institute of stable union in the Brazilian legal system. This contract is used to rule out the characterization of a stable union, in order to protect assets. In this sense, we seek to elucidate whether the dating contract can rule out the characterization of a stable union. The use of the contract is still under discussion, with doctrine and case law differing on its legal validity. Considering the complexity of the subject, the relevance of the research is justified by the growing demand for this contractual instrument. Based on bibliographical research and analysis of current legislation, as well as doctrine and studies published on the internet, we hope to assess this institute in terms of the levels of validity and effectiveness that are part of contract law, in order to achieve the main objective.
