This article analyzes the strategies adopted by the State for the social reintegration of ex-prisoners, faced with an inefficient penitentiary system. The aim is to specifically identify the State's challenge in achieving this proposal. This proposal was achieved through Bibliographic Research, which allowed the survey, collection, screening and registration of a set of publications, inherent to the social reintegration of those released from the prison system, forming a theoretical framework, with the perspective of improving and updating this knowledge . The results showed that the custodial sentence is manifested in a precarious prison environment, permeated by several inhumane situations, indicating that it is not a space that contributes to social reintegration. It is concluded that the State can create effective strategies for the social reintegration of inmates, as long as a penitentiary system is built with a satisfactory structure, where the prisoner can live in an environment with healthy, humane conditions, without violence and crime. This requires the guarantee of the Democratic Rule of Law for prisoners, based on the principle of human dignity, whose environment can be favorable to the adoption of socio-educational measures for the prisoner.
