SHARED CUSTODY IN FRONT OF LITIGIOUS DIVORCE

The research aims to portray in the face of cases of view so that there is a shared custody, given that there is a divergence between the cases, seeks to establish a new family configuration that focuses on the development of the minor, with both parents, protecting them and showing that the parents felt more effective, the combination of both parents, the combination of both parents. The problem that originated the study was based on the question: how can the complementary custody, extended in a process of enlightened adjustment, apply the principle of the best interests of the minor? Thus, demonstrate that joint custody promoted the smallest case of even greater development, and maintain family authority after confirming the objective over the child on equal terms. Through a bibliographically based qualitative research, it is justified by the need of the best operators in general to understand that a shared custody is extremely important to verify its operation, as much as its application in relation to the principle of the interest of the minor, in the process of litigious.
