This article performs a deep and meticulous exegesis on the retroactivity of the Non-Prosecution Agreement (ANPP) in the Brazilian criminal legal system. In this context, the work analyzes everything from jurisprudential controversies to the practical implications of the retroactivity of this innovative institution. The research culminates in the need to balance the constitutional principles governing criminal law with the pragmatic demands of an already overburdened judiciary. In this way, the article seeks a judicious hermeneutics that reconciles individual justice precepts with systemic operability, paving the way for the consolidation of a uniform interpretation by the Judiciary.
