JUDICIAL EXPERTISE TO ASSESS THE CAUSAL NEXUS OR CO-CAUSALITY BETWEEN WORKPLACE BULLYING AND PSYCHOLOGICAL HARM

In the context of contemporary labor dynamics, the issue of moral harassment in the workplace has emerged as a concern of considerable relevance. In view of this, this study aims to analyze the interweaving between moral harassment in the professional context and the judicial expertise of assessing the causal nexus or co-causality between the act and the psychological damage. For that, a documental, exploratory and descriptive research, of a qualitative nature, was carried out with secondary data from judgments of the Superior Labor Court. 31 judgments published in the period 01/01/2023 to 08/28/2023 were found, using the search descriptors moral harassment, expertise, causal and/or concausal nexus. It is considered, based on the findings, that psychological assessment plays a crucial role in the judicial expertise of cases of workplace moral harassment, providing a scientific approach to establish the causal nexus and/or co-causality between the act and the psychological harm, providing necessary subsidies for the judicial decision.
