The present work aims to present theoretical and practical foundations that constitute the Democratic State of Brazilian Law, starting with the exposition of the different experiences of democracy over time and their concepts. After a brief historical overview up to the 1988 Constitution, the need for democracy in the Brazilian State is identified, in order to promote social inclusion, so that every Brazilian can effectively participate in the democratic process, with equal capacity to influence political decisions. To this end, it is essential to strengthen democratic institutions, especially in this study the Public Defender's Office, whose main constitutional mission is the provision of free and comprehensive legal assistance to groups of socially vulnerable individuals, that is, on the margins of society. The study used the bibliographic review research methodology as an analysis tool, having as main source the understanding and observations made by some political scientists, philosophers and jurists.
