Abstract

This article has the purpose of highlighting the sexual exploitation of minors, which has been discussed worldwide as one of the extreme forms of violation of human rights and, therefore, has been a target of concern on the part of child and adolescent protection entities. And also the debate about the figure of the agent, whether or not he is indispensable for the configuration of the criminal type, regarding the sexual exploitation of minors in order to satisfy their own lust and as a form of merchandise. There is also an analysis of the characterization in the view of jurisprudence, in view of the protection of children and adolescents within the legal system, and its configurations, aiming at the way in which the victim is treated in view of the circumstances of the crime of sexual exploitation. Also presenting the controversy of the 5th and 4th criminal group of the Supreme Court of Justice.
