This article aims to demonstrate the lack of national regulation on what is or is not configured as Obstetric Violence and its direct relationship with the violation of human rights and the dignity of the human person based on the case of digital influencer Shantal Verdelho. After analyses regarding the forms of recognition of obstetric violence, both on the part of women and on the part of professionals, the need for it to be fought socially and, directly and specifically, legislatively was verified. At the state level, many states have a law specifying and conceptualizing Obstetric Violence, including the State of Rondônia with Law No. 4,173/17. Despite this, at the federal level there is no specific criminal type that condemns the practice that violates rights, and the victim must resort to the Civil and criminal sphere to hold the aggressors accountable.
