Abstract

Indirect discrimination in the criminal punitive sphere is a relevant and complex issue. It refers to situations where seemingly neutral punitive measures have a disproportionately negative impact on certain groups or individuals, even if there is no explicit discriminatory intent. The objective of this study is to analyze the incidence of indirect discrimination in the Brazilian penal system, assessing its impact on the punitive selectivity present in this Brazilian penal context, assessing its impact on the punitive selectivity present in this scope. Thus, for the accomplishment of this study were carried out bibliographical researches through articles and journals on concepts and theories related to jurisprudential about the proposed theme through qualitative research. It is hoped that this study will contribute to raising awareness about the incidence of indirect discrimination in the Brazilian penal system and to the development of effective strategies to combat this form of discrimination.
