This scientific work aims to address the light of psychology and criminal criminal law in relation to the serial killer, as to the challenges in identifying and criminalizing them. Through the bibliographic study was made an analysis from the perspective of how the legal system recognizes serial killers, as well as the diagnoses according to studies in relation to psychopathy, as well as sociopathy. Conceptualizing about culpability, as to its definitions and how they are applied to the serial killer. Elsewhere in bringing its elements, addressing the differences as to imputability, nonimputability and semi-imputability. Finally, a case study was made on João Acácio Pereira da Costa, better known as the Red Light Killer.
