ANALYSIS OF THE REFORM OF THE ELECTORAL CAMPAIGN FINANCING SYSTEM IN BRAZIL CONSIDERING FEMALE CANDIDATES

The struggles and movement in favor of expanding the viability and participation of women in electoral disputes have driven, throughout international and national history, the development of legal instruments and mechanisms for financing electoral campaigns, aiming to reduce gender inequality in the political space. In this way, even with the introduction of legislative and legal apparatuses of equality, the gender dispute for access to electoral positions still generates exclusion of women. This research analyzed the possible interferences of the new legal instruments (Constitutional Amendment nº 117, of April 5, 2022) in the strategies for expanding and financing the participation of women in the electoral process; in addition to identifying the influence of adopting criteria in the exercise of party autonomy and application of financial resources by reducing/expanding women's participation in the candidacy process and electoral dispute through a bibliographical review, of a qualitative nature, consisting mainly of books and scientific articles, legal, scientific and legislative standards. Among the results obtained, the following stand out: the possible interference of the new electoral financing instruments in the strategies for expanding/reducing women's participation in the electoral dispute process, as well as identifying the influence of the exercise of party autonomy in the application of financial resources based on criteria that need to improve the level of clarity, explicitness and objectivity in face of electoral regulations. The legal instruments with the greatest support for the theme were: the Federal Constitution of 1988, Federal Law nº 9.100/1995, Resolution-TSE TSE nº 23.605/2019, Constitutional Amendment nº 111 of September 28, 2021, Constitutional Amendment – EC nº 117 of April 5, 2022.
