The world is in the so-called "information age", due to the advances in technology that have emerged over time. These innovations have instantly transformed the entire social context, enabling the rapid expansion and availability of information through digital technology, which creates new challenges for the legal field. Most Brazilian legislation has not yet been updated to deal with the issues brought about by this new reality, resulting in a large gap in the protection of the rights to information and privacy, which may cause damage to people's lives. In this sense, this paper's main objective is to analyze the outdatedness of the law in the face of these new technological advances. The methodology used was a literary and jurisprudential review, and the analysis of concrete cases. From the study, the conclusion was reached that the law has not yet been able to fully keep up with technological evolutions and, many times, is outdated in relation to the new forms of social interaction. Furthermore, the problems that such outdating can cause were dismantled and through the results obtained, the best way to solve the problem in question was sought.
