ENVIRONMENTAL LICENSING: IMPORTANCE IN THE URBAN DEVELOPMENT PROCESS FOR THE MUNICIPALITY OF ILHÉUS

Abstract

Due to the rapid population growth, in small and large cities, it is important to discuss the urbanization process, especially with regard to the environmental issue. In this context, the purpose of this work is to address the importance of environmental licensing in the urban development process, focusing on the municipality of Ilhéus, based on the hypothesis that the granting of environmental licensing needs to be supported by the individual's right to an ecologically balanced environment for the present and future generations. The research will focus on urban expansion in the Municipality of Ilhéus, and will be developed in three stages: first, to investigate the theoretical and conceptual bases of environmental licensing, approaching the role of the State for Environmental Law, in a second moment, to evaluate the relationship between environmental licensing and urban development, identifying the main norms and legislation related to municipal environmental licensing; and then analyze the importance of popular participation in the scope of the regional environmental licensing process. Thus, scientific articles, scientific magazines and books in the field of Environmental Law were used to help identify the general aspects of environmental licensing, its parameters, the applicability and compliance with legislation related to the subject. Finally, the result sought is the urgent awareness of the use of environmental licensing, which is presented as an important public policy tool in its objective of protecting the environment for current and especially future generations.
