PARANÁ MILITARY POLICE PROTOCOLS FOR INTERACTION WITH INDIVIDUALS BELONGING TO TRADITIONAL PEOPLES AND COMMUNITIES

Traditional communities, defined in Decree No. 6,040 of February 7, 2007 — which established the National Policy for the Sustainable Development of Traditional Peoples and Communities —, are characterized by their own ways of life, intrinsically related to territory, culture, and the sustainable use of natural resources, which imposes on state action the need for differentiated approaches sensitive to their sociocultural specificities. In this context, this article analyzes the service protocols of the Military Police of Paraná (PMPR) directed at traditional communities existing in the state of Paraná, in light of national and international legal frameworks, as well as the principles of human rights and the protection of cultural diversity. The research adopts a qualitative approach based on a literature, documentary, and normative review, seeking to understand the operational and institutional challenges inherent to police action in these contexts. The results demonstrated that the Military Police of Paraná has an operational protocol for occurrences involving Indigenous peoples, as well as policing modalities that serve traditional communities with a focus on the institutional philosophy and strategy of community policing; however, no other specific procedures were identified for the remaining traditional communities existing in the State. The research suggests the need to expand the internal normative instruments of the Corporation, as well as to train police personnel for action alongside these peoples, aiming to grant greater legal certainty to military police officers and strengthen the protection of the fundamental rights of these populations. It also highlights the work already carried out by the Community Rural Patrol, the Environmental Military Police Battalion, and the Coastal Patrol with these populations, as well as the need to incorporate this topic into the training, continuing education, and curriculum updates of the Military Police of Paraná. It concludes that the adoption of technical guidelines and professional training aimed at serving traditional communities represent essential instruments for the effectiveness of public safety actions and for the consolidation of police action aligned with constitutional principles and international commitments assumed by the Brazilian State.
