THE END OF THE MANDATORY SINGLE LEGAL FRAMEWORK: CONSIDERATIONS REGARDING THE POSSIBLE IMPACTS ON PUBLIC EDUCATION

This article raises questions about the impacts of the end of the mandatory Single Legal Regime (RJU)—upheld by the Federal Supreme Court in November 2024—on public services and, in particular, on public education. To this end, a qualitative analysis was conducted based on a review of the literature and relevant documents. The findings demonstrate that hiring under regimes other than the statutory one undermines the State’s essential function of serving the common good and contributes to the precariousness of public services and public education. Based on this, it is concluded that advocating for the maintenance of the RJU for the majority of future public servants—especially those in the field of education—aligns with preserving the survival of the welfare state to the extent possible within the framework of capitalist society, acting as a barrier to the complete interference of capital in state decisions.
