Abstract

Parental alienation, characterized by the psychological manipulation of children or adolescents with the aim of breaking affective ties with one of the parents, constitutes a practice that generates serious emotional and legal consequences. Regulated by Law No. 12.318/2010, it can constitute crimes foreseen in the Penal Code, such as slander, defamation, or false accusation. This study analyzes the criminal implications of parental alienation in the Brazilian legal system, adopting a qualitative and interdisciplinary approach. Through bibliographic research, the relevant legislation, doctrine, and jurisprudence are examined, as well as psychological and sociological studies. The complexity of the subject requires not only an understanding of the typical conduct but also a critical analysis of the evidentiary difficulties that still limit the effective criminal accountability of the alienator. It is expected to demonstrate the need for criminal accountability in serious cases, as well as to propose preventive measures and public policies to protect the rights of children and adolescents, promoting family mediation and psychosocial support.
