This article was developed through research where bibliographic references were consulted, with the general objective of analyzing the specific legislation for the inclusion of children with Autism Spectrum Disorder in the Regular Education System, as well as investigating the effectiveness, efficiency and effectiveness of Law No. 12,764/12 regarding the guarantee of the inclusion rights of students with Autism Spectrum Disorder in the Regular Education System. The research is justified by the need to understand how the legal system, which gives special protection to people with autism, guaranteeing countless rights to this part of the population, addresses the provision of an egalitarian education aiming at the inclusion of children with autism in regular schools, guaranteeing the schooling of this public, focusing on their integral development and also so that these subjects develop skills and competences for a productive life in society. It appears that by having Law No. 12,764/12 as a basic rule to guarantee the rights of the autistic person, it provides better legal certainty for professionals who work in this context, as the legislation makes it possible to understand the emergency of assisting these individuals in their educational, personal and social realities. It is essential for legal professionals to be able to militate for specific laws for autistic people, given that the order that deals with inclusive education can also be committed to defending the rights that treat autistic people like any other disability.
