MITIGATION OF THE PRINCIPLE OF PRESUMPTION OF INNOCENCE IN FACE OF MEDIA ACTION IN THE FORMATION OF PUBLIC OPINION IN PEOPLE'S JURY COURT TRIALS

This article aims to analyze the influence of the media on the trials of the Popular Jury Court and how it impacts the principle of presumption of innocence. The starting point was the following question: Could the massive role of the press in covering crimes to be judged by the Popular Jury Court compromise the principle of presumption of innocence? Thus, the research was carried out using the qualitative method technique, with bibliographical and documentary research, as well as other scientific articles to understand how the phenomenon of mass propagation of news can influence the imagination of judges and tarnish the state of innocence of the defendant. It is inferred from the present study that further debate on the topic is necessary, as it concerns two constitutionally established rights. However, it is imperative to reflect on the power of influence of the media and the damage they can bring to the defendant's rights and guarantees during the process and in a future sentence.
