This study provides an insight into the Brazilian penitentiary reality, focusing on the penitentiary system in the state of Pernambuco, one of the most debated topics in criminal law today, not only in Brazil but worldwide. Objective: To analyze the Brazilian penitentiary situation, detailing the penitentiary system in the state of Pernambuco and highlighting the institution's ongoing resocialization program. Discussion: The negative aspects of custodial sentences are analyzed, as well as whether or not they fulfill their social function. The crisis in the prison system can no longer be concealed by our country's authorities. Given this perception of total omission and public neglect, this study lends itself to analyzing the problem. Methodology: The research is qualitative in nature, with bibliographical research that consulted relevant doctrines on the topic published in books, scientific articles, journals, documents, and official websites. The rationale for choosing this topic is its contemporary nature, as well as the hope of contributing to the academic field. Conclusion: The study concluded that the Penal Enforcement Law provides mechanisms to achieve the resocializing purpose of the sentence, but that the process is hindered by poor physical conditions and a lack of public policies, a vivid example of the lack of efficiency and effective government measures.
