Abstract

Slave labor corresponds to the fact that the employer subject the employee to the degrading situation and exploitation, including poor situations in the work environment. Having roots still in the period of slavery, this practice is still very present in the world, especially in Brazil, which has been the scene of numerous facts that show how much slave labor is being effective on homeland. Based on this scenario, the present study was aimed at analyzing the legal effects of contemporary slave labor in Brazil. In the methodology employed, it was a bibliographic review, based on scientific articles, books, periodicals and current legislation on the respective theme. Data collection was through database such as Scielo, Google Academic, among others, from 2018 to 2023. In the results, Brazilian law criminalizes slave labor. By way of example, art. 5, XLVII, of the Federal Constitution of 1988, asserts that the penalty of “forced work” is prohibited. In addition, reducing the analogous slave condition is a crime provided for in art. 149 of the Penal Code. In the practical field, the public policy of care for the victims of slave labor in Brazil is basically in the granting of unemployment insurance. Regardless of that person's working time, they are entitled to three installments of unemployment insurance, as well as the guarantee of indemnities, such as material and moral damages that that person suffered for exploitation.
