LA PROTECCIÓN DE LOS REFUGIADOS VENEZOLANOS DESDE LA PERSPECTIVA DEL SISTEMA JURÍDICO BRASILEÑO

The issue of Venezuelan refugees in Brazil has gained media attention in light of the Venezuelan humanitarian crisis, which has led to the migration of thousands of Venezuelans to Brazil. This paper aims to discuss the legal protection of Venezuelan refugees from the perspective of the Brazilian legal system. The methodology used was a bibliographic review of articles, doctrines, legislation, and undergraduate and graduate theses related to refugees, Venezuelan refugees in Brazil, and legal protection for refugees, with a quantitative, explanatory, and descriptive approach. It was possible to conclude that: a) The 1988 Constitution defends equal treatment for foreigners, prohibiting discrimination and aligning with human rights; b) The Refugee Law adopts a broader concept of refugee, being one of the most advanced laws in the treatment of refugees; and c) The Migration Law provides a less bureaucratic, more humane approach to the subjects, addressing various hypotheses for granting temporary visas, among others.
