Through a technical-legal Deductive analysis, this Article unveils the performance of the Federal Supreme Court and the Superior Court of Justice, via Mandate of Injunction, analyzed from the importance that the Supreme Courts acquire in the permanent protection of the population, especially Autists and Albinos, in the face of the legiferous omission, which pretermits the effectiveness of CF88 and the rights inscribed in the Magna Carta, as for Albinos and Autists in their fundamental rights to health, Dignity and Social Welfare. In conclusion, that for there to be Justice in the concrete case it is necessary that the Legislator be reoriented by the Judiciary at times, through Decisions considered activist by the most inattentive, however extremely necessary to mitigate the obstacles to Material Justice aimed at by the Magna Carta.
