ANENCEPHALIC FETUS: IMPOSSIBILITY OF EXTRAUTERINE LIFE OR CRIMINAL ABORTION?

Abortion of an anencephalic fetus is a complex and controversial issue in the legal field. The term "anencephaly" refers to a condition where the fetus does not have a properly developing brain, which results in an incompatibility with life after birth. In this context, the interruption of pregnancy in legal and ethical circumstances is discussed. The discussion about the abortion of an anencephalic fetus continues to be present in society and in the legal system. The study's main research problem is to analyze the legalization of termination of pregnancy in the case of anencephaly. It was divided, then, into 3 specific objectives, describing the concept of abortion, analyzing the protection of pregnant women in the interruption of pregnancy with an anencephalic fetus, and, finally, exposing the main points about abortion of anencephalic and human dignity. Where it is concluded that the abortion of the anencephalic fetus and its legal processes involve a series of complex issues, such as reproductive rights, women's autonomy, guarantee of health and protection of fetal life.
