The purpose of this paper is to analyze the Public Prosecutor, its consolidation and the growth of its prominence through the 1988 Federal Constitution, correlating it to the mechanism of the Democratic State of Law. From that point on, we observe the emergence of this state and its essential characteristics. Furthermore, the intention is to demonstrate the relevance of this institution to ensure the Democratic State of Law, as well as the activities entrusted to it, especially the defense of the legal order, democracy, social and individual rights unavailable. The deductive method of procedure was adopted as a methodology, through exploratory, bibliographic and documentary research.
