PLURALITY OF LEGAL ORDERS AND THE RECOGNITION OF INTERNATIONAL SYSTEMS FOR THE EFFECTIVENESS OF HUMAN RIGHTS: HISTORICAL AND PROSPECTIVE ANALYSIS

The article addresses the issue of the plurality of legal orders, with emphasis on the institutionalization of international systems for the protection of human rights to which Brazil is bound. To this end, it analyzes the historical evolution of the protection of human rights and the formation of the normative framework governing the UN and Inter-American system for the protection of human rights. Subsequently, it addresses the challenges of conforming the international and domestic legal order. The reflections presented are the result of a qualitative approach and bibliographic and of the norms that deal with global and regional instruments for the protection of human rights ratified by Brazil, in a critical and historical perspective. It appears that the effectiveness in the protection of human rights depends on the authentic interpretation of international treaties and on the state's commitment to the protection of these internationally protected rights.
