Abstract

The article seeks to discuss the procedures adopted by the criminal justice system in the treatment of victims of sexual violence and when the victim's revictimization is characterized, analyzing concrete cases and making references to the legal text. Institutional violence will be addressed at work to show which conduct is considered a crime, and what impacts are caused for the victim. For this, at the first moment presented the views on sexual crimes and the historical and legal construction about them and, from this exhibition, the elements of configuration of the crime of revictimization are presented, making analysis of concrete cases, which have gained great national repercussion, and which lead to significant legislative changes on the issue involving institutional violence and secondary violence. This article demonstrates the need to deal with this theme, and to expose the reason why women go through this aggression, in addition to primary aggression, in view of the analysis that implies understanding how the historical-social construction is linked with this problem faced in the Brazilian Courts, and how society has been responsible for these behaviors before the weight for these circumstances for the victim.
