Abstract

The purpose of this work is to expose the difficulties faced by the public administration, for the provision of the public service of basic sanitation, it aims to explain the historical context of the appearance of the laws of basic sanitation and the changes brought about by the validity of regulatory laws, such as the increase in conflicts over the exploitation of public services and water resources. On January 5, 2007, Law 11,445 was published, which regulated basic sanitation services. The Sanitation Law was recently amended by Law 14,026/2020 in several aspects; main one in the change in the definition of public basic sanitation services. New Sanitation Framework, through Law 14.026/2020, which allows the entry of the private sector in the provision of services in the sector, justified by the lack of private participation in basic sanitation services. The improvement of basic sanitation programs is due to the performance of existing programs, together with the creation of new programs. existing ones, together with the creation of new programs. As in the Pluriannual Plan (PPA), foreseen for the period between 2000 and 2003. The PPA contains the government's guidelines, objectives and targets for capital expenditures, and includes, among its objectives, “to expand sanitation services basic and environmental sanitation of the cities”. This objective is aimed at the universalization of services, complying with quality standards compatible with public health, preservation of the environment and consumer rights. And also to help in this search for these mentioned approaches, the research also used a bibliographical review, as a research method, which had requirements for this research, having as regulators for the work the production of scientific articles in the Portuguese language. The results obtained, from this analysis, the working hypothesis. A 10-year time frame (2010-2020) was used as a requirement to search for articles included in the electronic database: Scientific Electronic Library Online - (SCIELO). The results found, from this analysis, are confirmed, with investments related to the sector and the integration with other public policies is important and very necessary to be faced, it refers to the question of the integration of the sanitation policy with the other public policies. he current process of changes in the sector must consider the externalities of the sanitation policy and its relationship with other public policies. The implementation of an effective policy, which encourages service efficiency and considers the social benefits of sanitation actions and the interrelationship with other areas, require municipalities and states to generate reliable information and technical capacity. There is, for example, no integrated information system on sanitation, as well as a monitoring and evaluation methodology, which would make it possible to relate, at local, regional and national levels, sanitation issues with those of public health, environment and housing, leaving exposed to the precariousness of the existing basic sanitation policy.
