THE RESTORATIVE CIRCLE AS A CONSENSUAL INSTRUMENT FOR CONFLICT RESOLUTION

Abstract

This scientific article aims to explain the admissible foundations in Brazilian law about Restorative Circles and the difference of retributive justice, as well as to clarify the organization of the State and its role at the head of consensual methods of conflicts. In addition, explain the vision of the legislation, jurisprudence and also, doctrinal that are relevant in the speech. Also find out the distinction between restorative procedures, namely Conciliation, Mediation and Circles, in order to discuss their concepts and the importance of applying each one. In view of this, the means of bibliographical research will be used that meet what is necessary, deductive and exploitable so that any and all questions are answered. In addition to what has already been mentioned, the Circles have support in the legal system, since through spoon, courts and doctrines affirm that it is important to apply them in conflicts, although their effectiveness reaches not only the conflict, but also cares for the person and its interior, making people reflect and reach a consensus and agreements so that they live in harmony. In view of this, in search of results and then answered, the peacebuilding circles, have legal support in our Legal System and with its applicability, it is possible to reach the solution of conflicts, mainly what lives inside us, and resocializes the individual to society.
