STATE INTERVENTION IN THE SOCIAL FUNCTION OF PROPERTY

Abstract

This article aims at a brief summary of the main modalities of restrictions by the State on the individual right to private property. With this objective in mind, we intend to look for theoretical references in the great authors and scholars of Administrative Law in line with the Property Right and its social function, foreseen in the Federal Constitution of 1988. The consequence of this inquiry was a concise report on the general modalities of state intervention, their diferences, the reasons for such, and the purposes intended by the City Statute (Law nº 10.257/2001) as intervention instrument.
