Abstract

This research aims to analyze in Brazilian Criminal Law the possibility of applying the principle of insignificance in drug trafficking crimes, the second crime that most imprisons in Brazil. Therefore, it is necessary to analyze such an institute with some of the basic principles of criminal law. In this way, the article will show that although there are contrary understandings to the application of such a principle, recent decisions have admitted such application. Therefore, it is important to analyze the votes of each minister, where the possibility of harmonizing the principle of insignificance and the crime of drug trafficking is evident. This study consisted of applied research, of a deductive scientific nature, and with the comparative auxiliary method, as well as the explanatory one and, because it is a controversial subject and that remains current, it brought in its context legal foundations to show the reader of in a clear and cohesive way the majority understanding of specialists related to the theme.
