Abstract

The article opens dealing with the procedural historical context and the transition to reach the current conceptions, demonstrating the influence of the views on the State for the concepts and functionalities, the autonomy of procedural law, process models, theoretical aspects, as well as effective aspects of analysis of reality to seek to answer the question of the title, aiming to present the path traced for the procedural achievements in the Democratic State of Law and the importance of its preservation and improvement of a process for the parties.
