Abstract

This study aims to promote discussions about the problem that involves the transgender in the fulfillment of custodial sentences based on the fundamental rights that govern the national legal system. Thus, through a literature review, a historical course of the prison system, as well as gender issues, we sought to reflect on the current reality of incarcerated people. There is, therefore, a legislation of rights that emphasizes human dignity, but which, in practice, perpetuates stigmas and discriminatory attitudes through violence against the transgender population. Therefore, it emphasizes the need for an institutional restructuring at the social, political and legal level that, in fact, contemplates constitutionally foreseen issues in practice.
