Abstract

This article has as its theme “Real Power Factors: Private Militia” and seeks to examine, from a legal and sociological point of view, the origin of private militias. It seeks to understand how the absence of the State in providing effective public security led to the strengthening of private militias, as well as the way these groups act and how their proximity to part of the state police force directly influences their acceptance by society. It will also address the effectiveness of Law nº 12.270/2012, instituted to curb the actions of militia groups, in view of the theory of real command factors idealized by the German writer Ferdinand Lassalle.
