HEALTH AND SAFETY AT WORK: THE ESOCIAL AS AN INSTRUMENT TO GUARANTEE THE FUNDAMENTAL RIGHT OF THE WORKER

Abstract

The present research project aimed to analyze the Law within the Health and Safety at Work of Brazilians, as well as to explain the Laws, Norms and Conventions that guide such rights, as an instrument to guarantee the Fundamental Right of the worker in Brazil after the implementation. of the unified system of information on the working life of Brazilians, eSocial, understanding whether the system is in fact effective for workers' health. Still, we present, through bibliographical research, the importance of the system in the search for guaranteeing the fundamental right of the worker, using the Federal Constitution, Consolidation of Labor Laws and international conventions, in order to carry out a qualitative analysis of the information collected through analysis. and historical evolution of the SST Norms, showing whether there is a healthy environment for the worker, as well as the legal provisions related to the subject, in order to analyze whether the Federal eSocial program contributes in a transparent way, as it is a unified information system.
