REGULATION OF MEDICINAL AND SCIENTIFIC USE OF CANNABIS IN BRAZIL

Considering the epidemiology of the use of this herb in the country and the growing search for the therapeutic properties of the plant, the use of Cannabis (marijuana), for medicinal and scientific purposes, has been much discussed regarding the substances extracted from this plant, highlighting the most importantly cannabinoids. This topic, once appreciated in Brazil with a big label (taboo), has been highlighted in the medical field. It is also a constant focus of debate by class councils, teaching and research institutions, jurists, regulatory bodies and legislators. The present work aims to regulate the medicinal and scientific use of Cannabis in Brazil, since its scientific and medicinal properties have been proven, demonstrating a direct impact on the lives of people who need it therapeutically. The Right to Health is one of the most solid pillars of the Federative Republic of Brazil, being guaranteed by the Federal Constitution of 1988 in the scope of Human and Social Rights. Thus, it is up to the State to ensure that every citizen is provided with mechanisms that provide them with well-being and dignity in their existence. The Magna Carta safeguards the fundamental precepts of the Right to Health. The methodology adopted is exploratory research that, in most cases, assumes the case study model, substantiating the in-depth study of the object through other designs already mentioned.
