CONTROL OF WORK DAYS IN THE LIGHT OF THE INTRODUCTION OF TELEWORK: PRACTICAL REPERCUSSIONS BROUGHT BY THE COVID-19 PANDEMIC

The present work proposes to study the main changes introduced in the control of the workday of the employee in telework regime from the emergence of the COVID-19 pandemic in Brazil, configuring as the main objective the analysis of the register of the workday of the telework modality after the changes in the labor scenario caused by the Coronavirus and what are the repercussions for the worker. It is undisputed that in the labor field one of the biggest changes experienced was the telework regime, or as it is also known, remote work. In this path, topics such as the possibility of recognizing overtime as a result of overwork must necessarily be discussed, since one of the primacy of legal science is precisely to accompany social transfigurations, including those caused by the pandemic, which have been accentuated. In this study, the methodology of legal research, exploratory bibliographic and documental, based on the analysis of legislation, doctrine and jurisprudence is used. It uses the deductive method and the technique of qualitative data analysis. The data and information brought throughout the present analysis has the power to bring an updated and contextualized study of the telework regime, which has been gradually used even after the appeasement of the numbers of cases and mortality rates arising from the pandemic scenario, which is why the benefits and possible disadvantages of the institute will also be studied, in addition to the practical consequences to which the worker is attached from the aforementioned introduction.
