The theme of the research will be to demonstrate the ineffectiveness of the current Brazilian prison system and to bring as a possible solution on the subject the privatization of prisons. When analyzing the historical aspects of the prison system in Brazil, one is faced with the veiled reality that the attention of the State has always been incipient when it comes to the prison population. The effectiveness in the administration of the prison system generates benefits for the inmates, the State and society as a whole, since the detainee will serve his sentence with dignity, as determined by the Criminal Execution Law. The proposed problem is: is privatizing the prison system in Brazil the solution to achieve satisfactory levels of quality in prison administration? When approaching the proposed theme, the article has the general objective to describe the structure of the current prison system and the difficulties faced by managers to make it effective. The specific objectives will identify the main flaws of the Brazilian prison system and analyze the possibilities of privatizing the prison system. An inductive method of approach will be used, a source of bibliographic, legal and jurisprudential research.
